Types of Air Accident Claims

Depending on the type of flight you were taking, there are different rules that apply when it comes to claiming compensation. Broadly, the rules are as follows:

  • If you were injured on a domestic flight within the UK, then you can claim against the airlines using UK law.
  • If you were injured on an international flight that was taken as part of a package holiday, then you can claim against your tour operator.
  • If you were injured while on an international flight, which was not part of a package holiday, then the rules are a little more complicated. International flights are governed by the Montreal Convention. That is, any flight where the place of departure and the final destination are in two different countries is classed as an international flight. If you suffer personal injury or a relative/close friend suffered death on an international flight, or there was passenger delay, baggage delay or baggage loss then you can claim under the Montreal Convention.

Whereas on a domestic flight the limitation period is three years, under the Montreal Convention you have two years to claim compensation from the date of the accident.
