The Scottish Government has recognised that, nowadays, couples do no choose to cohabit instead of to marry; they just cohabit. As such, since 4 May 2006, couples, both same-sex and opposite-sex, who are (or were) living together as husband and wife, have had the opportunity to make a claim against their former cohabitant for financial losses suffered during the relationship in the interest of the other cohabitant.

It is also open to a former cohabitant to make a claim in the event of the death of their cohabitant provided that they have passed away without a will.

Unlike with married couples, cohabitants do not have an entitlement to certain money and property, they only have the right to make a claim. The time limits for doing so are strict and it is important to seek advice promptly when your relationship ends.
