Types Of Insolvency

In Scottish law there are two types of insolvency

  • Sequestration- this is if you can’t pay back your debts within a realistic timeframe
  • Protected Trust Deed Under Bankruptcy- a repayment of debt scheme that lasts 4 years or over and one pays back as much as they can in monthly installments.

Our Fee Structure

Jones Whyte Law believe in transparent and fair fees. More often than not we can offer a fixed fee cost for sequestration and insolvency cases. In some circumstances, it will not be possible to offer a fixed fee rate. If this is the case we will offer an educated estimate based on the volume of the work we predict will need to be carried out.  

Protection Against Creditors

Insolvency cases can move at great speed and we always advise that you have caveats in place for protection against proactive creditors which are looking to take interim action.
