Festive Client Testimonial | Commercial Lease Case Study


As 2019 draws to a close, Jones Whyte’s property team looks back on a tremendous year of growth in which the team, itself having welcomed a number of new colleagues, has been proud to help its highest number of clients, both old and new, achieve their goals.

One of the firm’s most long-standing clients sought the property team’s advice on a few occasions this year and, to enable us to illustrate some of the areas in which the team can assist a range of clients, has kindly allowed us to share details of a few crucial times when the property team worked with Mr. C., his business, and his family to deliver results in the lead up to what is traditionally his busiest time of the year.

Mr. C. approached the team in January following a highly successful 2018/2019 winter trading period and explained that his first priority this year was securing a new lease of commercial land and property for his expanding operations base in what we are only permitted to disclose is a particularly northern (and often snow-covered) part of Scotland.

The complex negotiations included the acquisition of swathes of new ground and the securing of various new rights of access for Mr. C.’s fleet of unconventional semi-airborne delivery vehicles so he was relieved when Jones Whyte took the reins. Whilst he is no stranger to reading through detailed documents (and, especially with lists, is known for his tendency to check them at least twice), Mr. C. knew that the needs of his business would be best served by instructing Jones Whyte to negotiate the new lease to ensure that the most favourable terms could be agreed as his business (and its many employees) prepared to move to a brand new manufacturing and distribution facility.

Completion of this deal early in the year allowed the team to assist Mr. C. in successfully negotiating a short-term sub-lease of part of the new facility to one of his oldest corporate associates, Mr. E. B., whose own seasonal confectionary delivery business approached its peak distribution time in April.

In an age of increasing competition from international couriers and online retailers, Mr. C. again instructed Jones Whyte in summer as he sought to establish a joint venture project with a former business rival, Mr. G. Although direct negotiations had previously neared a cliff-edge, Mr. C. was delighted when the joint venture was finalised in July and operations got off to what was described to us as, literally, a flying start.

Autumn saw the team complete many residential property transactions including the first for Mr. C’s daughter who was excited to have reserved her first home. Jones Whyte’s New Build team was delighted to be able to help the youngest member of the family through what was initially a daunting process, not least of all as she spent most of her time travelling the globe in her role as Operations Director for the family business. With regular updates provided by email and telephone, her early concerns were quickly eased and she was able to take comfort in knowing that her transaction was in safe hands. The thank-you card, which arrived just last week, including a photo of the smiling first-time buyer clutching her keys, was the peppermint icing on the cake.

Heading into the new year, Jones Whyte looks forward to assisting clients old and new as they plan for the future. Whilst the team is not in a position to disclose the nature of any of Mr. C.’s ongoing projects, which are for the time being strictly under wraps (and, in some cases, ribbons and bows), new enquiries are always warmly welcomed.
